The TPU Defense Program focuses on preventing vulnerabilities in tenant rent histories and responding to TPU audits. In addition, it supports investigations by the Division of Housing and Community Renewal into buildings with J51 tax benefits that may have deregulated units.
The program constitutes a response to the DHCR’s Tenant Protection Unit, which triggered the initiation of an aggressive surveillance and enforcement program that reportedly relied on inaccurate and incomplete data. The Tenant Protection Unit also permits the legal increase of rent amounts that may occur due to apartment improvements upon vacancy, such as vacancy allowances, longevity bonuses, and the like.
